Annual Payment - If you choose this form of payment, your membership will run through the annual period at which time you can renew. If you allow your membership to expire, you have 30 days to renew without having to pay the joining fee again.

Termination Policy

No contracts! If you wish to terminate your membership, please give the YMCA a written notice by the 1st day of the month. Cancellation forms are available at the Member Services Center to assist with proper notification. Membership fees are non-refundable, and all membership cards must be returned upon termination.

The YMCA reserves the right to cancel memberships due to non-sufficient funds and/or noncompliance of the YMCA Code of Conduct.

Facility Usage

• Participating in programs to build a healthy spirit, mind and body; never engaging in the use, sale, dispensing or possession of illegal drugs or narcotics, or the unsanctioned use of alcohol on YMCA premises.

MEMBERSHIP WAIVER:

In consideration for being permitted to utilize the facilities, services, and programs of the YMCA for any purpose, including but not limited to observation or use of facilities or equipment, or participation in any program affiliated with the YMCA, without respect to location, the undersigned, for himself or herself and any personal representatives, heirs, and next of kin, hereby acknowledges, agrees and represents that he or she has, or immediately upon entering or participating will inspect and carefully consider such premises and facilities or the affiliated program. It is further warranted that such entry into the YMCA for observation or use of any facilities or equipment or participation in such affiliated program constitutes an acknowledgement that such premises and all facilities and equipment thereon and such affiliated programs have been inspected and carefully considered and that the

undersigned finds and accepts same as being safe and reasonably suited for the purpose of such observation, use, or participation.

IN FURTHER CONSIDERATION OF BEING PERMITTED TO ENTER THE YMCA FOR ANY PURPOSE, INCLUDING BUT NOT LIMITED TO OBSERVATION OR USE OF FACILITIES OR EQUIPMENT, OR PARTICIPATION IN ANY PROGRAM AFFILIATED WITH THE YMCA, WITHOUT RESPECT TO LOCATION, THE UNDERSIGNED HEREBY AGREES TO THE FOLLOWING:

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the YMCA, its directors, officers, employees, and agents (hereinafter referred to as “releasees”) from all liability to the applicant, his personal representatives, assigns, heirs, and next of kin for any loss or

damage, and any claim or demands therefore on account of injury to the person or property or resulting in death of the applicant, whether caused by the negligence of the releasees or otherwise while the applicant is in, upon, or about the premises or any facilities or equipment therein, or participating in any program affiliated with the YMCA, without respect to location.

I HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may incur due to the presence of the applicant in, upon, or about the YMCA premises or in any way observing or using any facilities or equipment of the YMCA or participating in any program affiliated with the YMCA whether caused by the negligence of the releasees or otherwise.

I HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to negligence of releasees or otherwise while in, about, or upon the premises of the YMCA and/or while using the premises or any facilities or equipment thereon or participating in any program affiliated with the YMCA.

I further expressly agrees that the forgoing RELEASE, WAIVER AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the law of the State of Florida and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I HAVE READ AND VOLUNTARILY SIGN THE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

ELECTRONIC FUNDS (EFT) or CREDIT CARD AUTHORIZATION:

I authorize my bank or credit card institution to honor preauthorized Electronic Funds Transfer (EFT) drawn by the YMCA of Greater St. Petersburg on my account for membership payments as indicated. When the bank honors the EFT (or credit card) by charging my account, such transfer shall constitute notice of payment due and my receipt for the payment. Should any preauthorized EFT or credit card not be honored by said bank or credit card institution, when received by them, then it is understood that the payment is to be made by me in the amount of said payment plus a $25 service charge. The YMCA of Greater St. Petersburg will debit the monthly membership fee on the 20th of each month. I understand that I must set up EFT (checking or savings account) draft in person at the Jim & Heather Gills YMCA.

Each new member of the YMCA can receive a Health and Well Being Consult with a Wellness Staff Member for Free! This consult is designed to help new members get a successful start on their health and well being goals. All youth ages 13 to 15 will need to complete a Heath and Well Being Consult prior to working out in the Wellness Center.
